ESI SKI SCHOOL TERMS AND CONDITIONS OF SALE :

General conditions of sale for ESI ski schools :

These general terms and conditions of sale (hereinafter referred to as the "GTCS") define the legal framework for relations between ESI School and its clients (hereinafter referred to as the "Client(s)").

The ESI School and the Client may hereinafter be referred to jointly as the "Parties" or individually as a "Party".

The purpose of the GTCS is to define all the conditions under which the ESI School markets its services (hereinafter referred to as the "Services"), which are available by registration only.

They therefore apply to all sales of services made to the ESI School.

Consequently, placing an order implies the Customer's full and unreserved acceptance of the GCS.

The Customer declares that he/she has read the GTC before booking and purchasing Services and accepts them without restriction or reservation, in all their provisions.

In the absence of the Client's express acceptance, any condition contrary to the GCS will therefore be unenforceable against ESI, regardless of when it may have been brought to the Client's attention.

The GTC may be updated from time to time; however, the applicable GTC will always be those in force at the time of purchase of the Services.

The General Terms and Conditions are available at all times on the ESI School website and at the ESI School offices.

Season opening :

The ESI School is open from 30/11/2025 to 04/05/2026.

Services :

The Services offered are those presented on the ESI School website and in its offices.

They include :

  • Teaching services, in particular individual or group lessons in skiing, snowboarding and other board sports;
  • Possibly additional services (lift passes, insurance, meals, etc.).

Participation :

Participation in Teaching Services requires :

  • Good physical health (in special cases, contact the ESI School)
  • Winter sports equipment,
  • And respect for the instructions given by the instructor.

The Customer acknowledges having full knowledge of these conditions for participation in the Services.

The Client releases the ESI School, its directors and members from all claims and legal actions relating to injuries or damage caused to his/her person and/or to third parties and caused in any way whatsoever, arising from or as a result of his/her participation in the subscribed Services.

 

Supervision :

ESI's instructors are professionals with state diplomas in their specialities (or in preparation for their state diploma).

All participation in the Teaching Services is subject to their assessment on the basis of the moral and physical aptitudes of the students.

 

Safety :

The feasibility of any lesson is subject to the assessment of the instructors according to the weather and snow conditions and the ability of the participants.

All the instructors have a radio or telephone link with the resort's piste service and the ESI School's head office.

Weather conditions :

Under no circumstances will weather conditions be a reason for the Client to cancel or postpone the Services as long as the Services are provided by the ESI School.

For this reason, the Customer may not claim any reimbursement for the Services subscribed or postponement of their performance.

Insurance :

Teaching Services do not include insurance.

The Customer is therefore informed that it is their responsibility to take out a personal insurance policy covering at least the bodily injury to which they may be exposed as a result of their sporting activities, in accordance with Article L. 321-4 of the French Sports Code, as well as any cancellation of lessons, medical assistance and repatriation costs.

Order process :

Bookings :

Services may only be ordered by reservation:

  • Or directly at the ESI School offices,
  • Or on its online booking site,
  • Or on the ESI central booking platform.

The possibility of booking Services is subject to their availability and consequently to their validation by ESI School.

For Services during school holiday periods, Customers are therefore strongly advised to book in advance.

The Customer may order Services on his or her own behalf or on behalf of one or more persons close to him or her; in the latter case, the Customer acknowledges that he or she has received authorisation from the person close to him or her to use his or her personal data and to subscribe to Services on his or her behalf.

The Customer is solely responsible for the truthfulness and accuracy of the information he or she provides when booking the Services on his or her own behalf and/or on behalf of third parties.

The Customer may not assign or transfer to anyone else in any way whatsoever, whether free of charge or in return for payment, any Teaching Service subscribed to in his/her name or in the name of a relative.

Payment :

Services are payable in full when they are booked.

If the Customer books Services remotely (website or ESI central booking platform), payment can only be made by bank card (VAD).

The following methods of payment are accepted for on-site bookings at the ESI School offices: Credit card on electronic payment terminal, cash, holiday vouchers or ANCV Sport.

Order validation :

The reservation of Services only becomes definitive once full payment of the corresponding price has been received and validated by the ESI School.

Once a definitive booking has been made for the Services, a course card will be issued and sent electronically or handed over on site, depending on the booking method used.

Any order implies express and irrevocable acceptance of the prices and descriptions of the Services, as well as the GTCS.

Online ordering :

For all stages of access to its online sales site or to the ESI central reservation platform and of the order process, the ESI School has only an obligation of means.

Consequently, it cannot be held liable for any inconvenience or damage inherent in the use of the Internet, in particular a break in service or connection failure to the ESI School online sales site or to the ESI central reservation platform, external intrusion or the presence of computer viruses, or any event qualified as force majeure in accordance with case law and the law.

 

Right of withdrawal for online orders :

The right of withdrawal provided for in article L 221-18 of the French Consumer Code for the benefit of consumers in the context of distance selling is not applicable to the Services insofar as they constitute, within the meaning of article L 221-28 12° of the same Code, leisure activity services to be provided on a specific date or during a specific period.

 

Modification and Cancellation of Services :

  • Any withdrawal or cancellation of the Service by the Customer will not give rise to any reimbursement or postponement, except in cases of force majeure.
  • In the event of an accident during the week, no reimbursement will be possible; documents can be provided for your insurance.
  • No refund or postponement of the Event will be made:

Any Event that is interrupted or not consumed due to the participant's insufficient physical and/or technical level; an event where the Event is interrupted for reasons beyond the control of the ESI School (ski lift stoppage, bad weather, safety measures, etc.);

  • Modification or cancellation by the instructors, with or without prior notice, of the Services for reasons relating to weather or safety conditions;
  •  The timetable for the Services may be modified according to the opening and closing times of the ski lifts without any participant being able to claim any compensation whatsoever.
  • The ESI School may cancel, without prior notice, the Teaching Services booked by a Client if there are fewer than 4 participants in a group lesson or if an instructor is unforeseeably unavailable and cannot be replaced immediately: in this case, the Client will be reimbursed all sums paid for the Service in question.
  • In the event of inappropriate behaviour or disruption to the course, the instructor reserves the right to exclude the child from the group, without entitlement to any refund.

 Price :

The prices of the Services offered on the ESI School website and in its offices are indicated in euros and include all taxes, taking into account the VAT applicable on the day of registration and payment.

Any change in the rate may be reflected in the price of the Services.

The prices of the Services are those in force at the time of registration of the registration requested by the Customer.

The ESI School reserves the right to increase its prices at any time; the price increase will take effect on the date of publication of the new prices online.

In the event of a pricing error (price obviously lower than the actual value of a Product), ESI reserves the right to cancel the order and, if it has been confirmed, to reimburse the sums paid as soon as possible; in this case, ESI will not be obliged to pay any compensation to the Customer.

The prices quoted for Teaching Services do not include insurance, equipment or lift passes.

These are the subject of Additional Services which, if available, are invoiced separately according to the rates displayed on the ESI School website and in its offices.

Performance of Services :

In order for the Services purchased to be carried out correctly, the Customer undertakes to provide truthful and sincere information during the ordering process and subsequently to comply with the instructions given to them in the e-mail confirming their booking, in particular with regard to the place, day and time of the meeting for the start of the Teaching Services.

In the event of late arrival at the meeting point, the Customer will not be entitled to any reimbursement, even partial, of the price paid, nor to any compensation.

The same applies in the event that, for a group lesson, the instructor in charge of the group corresponding to the level declared by the Customer decides to change to a group that corresponds to the actual level of the student, subject to availability: it should be remembered that the homogeneity of the level of the students in a group is decisive for the smooth running and quality of the Main Services.

 

Photos and videos :

ESI School uses photos and videos taken during the performance of the Services on its social networks and/or for promotional purposes.

Participation in the Services implies authorisation for participants to have their image used in this way.

However, the Client has the right to revoke this authorisation at any time by informing the ESI School in writing; if this refusal is made after the production of any type of media representing the Client or his/her family, the Client agrees in advance to

allow the ESI School sufficient time to produce an equivalent communication.

Responsibility :

Principle :

ESI cannot be held liable for any damage resulting from errors in documents or information provided by the Client.

Except in cases of gross negligence or wilful misconduct, the ESI School's overall liability to the Client under the GCS, whatever the legal basis and the nature of the loss, may not exceed the price paid by the Client.

This excludes any non-performance or faulty performance due to a case of force majeure or an act of God as referred to in article 17 below or due to the Customer.

The ESI School's overall liability under the GCS is limited solely to direct material damage caused to the Client resulting from duly proven faults for which it is responsible.

In the event of an accident :

In the event of an accident caused by a third party, the instructor and the ESI School are under no obligation to ascertain the identity or contact details of the third party.

Neither the instructor nor the ESI School has any obligation of result in this respect.

 

Data protection :

The ESI School collects personal data from the Client and/or those close to the Client via the Client's intermediary for the sole purpose of responding to requests for information and booking of Services, for monitoring files, for the correct maintenance of its accounting and IT databases and its schedules and/or for commercial monitoring purposes (in particular administrative, accounting, commercial and statistical management) or for information on the latest news from the ESI School and its Services.

Personal Data is collected within the limits of the information that is strictly necessary for Ecole ESI to carry out its Services and, more generally, to comply with the General Terms and Conditions of Sale.

This personal data remains strictly confidential.

This data is intended for use by the ESI School but may also be communicated to partners or sub-contractors of the ESI School in order to ensure the proper execution of the Services ordered by the Client or to assist the Client in meeting its own needs.

However, these third parties are only authorised to use said personal data as subcontractors for and in the context of the service commissioned from them by the ESI School.

The ESI School ensures beforehand that these trusted third parties act in accordance with the rules laid down by the French Data Protection Act no. 78-17 of 6 January 1978 as amended and the French Data Protection Regulation no. 78-17 of 6 January 1978 as amended.

European Directive 2016/679 of 27 April 2016 on the protection of personal data (hereinafter referred to as the "Personal Data Legislation").

In application of the Legislation relating to personal data, the individuals concerned by the data collected by ESI School have the following rights:

  • Right of access to personal data ;
  • Right to ask questions about the use of their personal data;
  • Right to rectify personal data;
  • The right to object, on legitimate grounds, to their personal data being processed or used for canvassing purposes, particularly commercial canvassing;
  • The right to define directives concerning the fate of their personal data after their death.

The natural persons concerned may exercise all of these rights at any time with the ESI School by sending a request to this effect by post or e-mail. The ESI School responds to requests from the individuals concerned as quickly as possible and in accordance with the applicable law.

The data collected by ESI is kept for the prescribed legal period.

Ecole ESI undertakes not to violate the privacy of Users and to take all necessary precautions to preserve the security and confidentiality of their personal data and in particular to prevent it from being modified, damaged or communicated to unauthorised persons, subject to any obligations it may have under French law no. 2004-575 of 21 June 2004 for Confidence in the Digital Economy.

Force majeure :

Performance by the ESI School of all or part of its obligations will be suspended in the event of a fortuitous event or force majeure, as defined by article 1218 of the French Civil Code, which hinders or delays performance.

This includes, but is not limited to, war, riots, insurrection, social unrest, epidemics and strikes of any kind.

The ESI School will inform the Client of any fortuitous event or force majeure within seven (7) days of its occurrence and may suspend performance of the Services for the duration of the impediment, without being held liable in any way whatsoever.

In this case, performance of the Services will be postponed for a period equal to the duration of the said impediment.

18 - Applicable law and dispute : 

All provisions of the GCS are governed by French law and interpreted in French.

In the event of a dispute, after notifying the management of ESI 2 Alpes by registered letter with acknowledgement of receipt, and in the absence of a satisfactory response or a response within

sixty (60) days, the Customer may refer the matter free of charge to the Consumer Ombudsman, whose contact details are available on his website: www.mediateur-consommation-smp.fr.

Independence of clauses

If any of the provisions of the GTCS are found to be invalid or unenforceable, this will not affect the validity or enforceability of the remaining provisions of the GTCS.

Disclaimer

The fact that the ESI School, at any time whatsoever, does not require performance by the Client or does not avail itself of any provision of the GCS may not, under any circumstances, be interpreted as an express or tacit waiver of its right to require scrupulous performance of the commitments entered into by the Client.
